By the way fuckwads the man who was killed by CT goons is Djo Bwabwa Kalamba. He was laid to rest at Mount Hamilton Cemetery. As reported by a variety of news papers he was chased and pinned down by 5 good ole CT boys. Maybe one of them had a rope. So you arm chair coroners have all the fucking facts right? Somebody said he died because of heat stroke. Really? How the fuck could you know that considering the coroner still didn't know at the time.


umm because the coroner DID release that in the end and no charges were pressed because he died due to his own causes not the employees. research your information if he killed him hed be in jail, but hees not, were some laws broken sure but not murder. honestly people

I have shopped at 777 Upper James, Hamilton since it opened and have only had a problem once so I will not change will continue with this branch.

I wil l spend my money at walmart from now on

Sorry, must be more to the story. They have to deal with the defect. It is the law and they can not refuse to help you. Ask for a new one if it is defective. You usually have at least a year on small appliances.

Your situation is fairly common: a loyal shopper who is suddenly being treated poorly on a return.

Because I had kept it for almost a month I was told that it was not a returnable item,

CT has horrible policies on defective items. They will claim for some items that your only option is to use the manufacturer's warranty.

If it were unused and resellable, they should have given you a refund within at least the first 30 days.

and the rude woman behind the counter told me that they are not a rental company.

Some people try a different CT stores, where the staff aren't so paranoid about fraud.

You can also try their 1-800 customer service number, to see if they will help.

Another option is to apply your rights under the Ontario Consumer Protection Act to cancel the transaction because the item is not 'of merchantable quality".

Regarding the requirement for Ontario retailers to provide refunds for defective products, two Ontario laws are especially relevant:
- The Sale of Goods Act (SGA of 1994), to be found at "Sale of Goods Act, R.S.O. 1990, c. S.1".

- The Consumer Protection Act (CPA of 2002) to be found at "Consumer Protection Act, 2002 - O. Reg. 17/05"

To head off the usual questions, some notes are in order regarding policies and warranties:
- There is no law requiring a store to provide a refund or exchange simply because a customer changed their mind.

- However, most stores have their own policy regarding refunds and exchanges for ‘change of mind’ returns, in order to attract customers.

- When a product is defective, a customer may be able to obtain an exchange or a repair using the manufacturer’s warranty, or a separately-purchased extension to that warranty.

- A store provides a policy. A manufacturer provides a warranty. It's important to keep that straight.

- Nothing in the manufacturer's warranty limits what the store could choose for a policy regarding refunds or exchanges.

- If a customer would prefer a refund (instead of an exchange or repair), the laws of Ontario require that the retailer (not the manufacturer) provide a refund, as explained at the links provided.

Regarding the links I have listed:

I neither hate her or love her....she has a job to do and does it.....kinda like Nancy Grace....and if you think they are doing their jobs for free, well guess again.
People should read the links you provided, they actually tell the whole story. There are others as well on her blog, like how Dick Smythe now shops at CTC because of Home Depot's lousy return policy or how CTC handled a customer complaint to the customer's satisfaction on a return.
Give the whole story not just snippets that only back your claim. There is always two sides.....you face so much opposition because you only give one.

wow speaking of liars, ellen roseman told the biggest lie of them all in that article that "she uncovered the ecofee disaster" in ontario. i've had a fair amount of involvement in the legalities around eco-fees and she certainly was not part of the solution. literally the day they were implement in ontario it was a disaster. the government failed miserably to correctly assess values for the fees based on the size of the container, and provided very vague instruction to all of the retailers including walmart, canadian tire, home hardware, napa, carquest to name quite a few.

I guess you will just ignore my comment about Ellen Roseman's commentary about Dick Smythe (because it goes against your "theory"). Or my comment about two sides to every story ( because rationale people know it to be true) . Take your one-sided, unhelpful bull elsewhere, start offering some sort of realistic solutions to real issues, not just the made up ones in your somewhat feeble mind.
