    Sad really, sad.
Crappy Angry guy really mad that Walmart shoppers are filling up his parking lot lol.

Say, can you pay the bills this month? No? The creditors are coming, but how soon? Can't you ask the bank to increase your credit a little bit, or how about a bridge loan to get you over the hump? I'm sure your millionaire status is all that it takes. lol. Don't give up hope, I'm sure, you'll be selling lots of rakes and snow shovels, thanksgiving and christmas will be huge money makers lol.

Better deals at Walmart, Rona, Lowes, Homedepot etc lol.

    This is my favourite part:

"insist on a refund if the product is defective on unsafe. Under the law, stores have an obligation to sell merchandise that is saleable and suits the intended purpose -- no matter what their return policies may say."

No doubt the Crappy People will be by soon, to tell use how that really means:

"You have to settle for a repair, or maybe an exchange, if that's all we want to give you. And Crappy Tire isn't doing anything against the law, so it's perfectly legal to refuse refund or even exchanges."

Now for an Important message to CT Owners from a shopper.

Keep in mind: there aren't laws regarding unwanted goods, but there are laws requiring refunds for defective items, or items that don't perform as advertised/described. And the stores can't just post any old policy they want regarding defective items, and use that as an excuse to deny a legally required refund.

"If you want a refund or exchange based on an unfair practice, you have legal rights and the retailer must address this issue."

(Crappy People will tell you that you have to settle for a repair, so find out for yourself!)

You can also call them at 416-326-8800 or 1-800-889-9768.

They can fill you in on the implied warranty for merchantability, unfair practices, and so forth, and help you get the refund.

Based on the stories on this site about suing Crappy Tire, the store may force you to file the lawsuit first, and then give you the refund. (Which explains why there is so little case law - Crappy Settles Out of Court!)

    Best of luck!
Nice thread title. The one I had in mind wouldn't have had as many google hits.

I'm glad you put this up as I'm sure many many reasonable, honest, law-abiding shoppers have been down this road before including trying to reason with the store owner.

Lots and lots of examples of winning small claims court cases to show first time litigants what the judge is looking for, the questions that will be asked, what to bring etc.

The court system works better with you in it!

It's a bit long, but it sums up the kind of people who run this corporation, and run these stores.

Didn't think about the Google impact - but this site sure does show up a lot when "Canadian Tire" is in the search string.
