    Though I would check my pressure washer sales this year....98 units, including all electric Simonize models, Briggs and /Stratton gas, and Diamond gas, and Karcher electric and gas. Guess what? Only one return due to a defect (faulty carburetor)

    First of all, there's no reason to think that the Crappy People who post so many lies here, would suddenly start telling the truth. See Why Do CT Defenders Post So Many Lies Here? for a list of their usual lies, including many about these "repair only" products.

    Secondly, if the Crappy People are for once not lying, why don't they post some sales figures and return rates that can be verified? Instead, all we get is unsubstantiated claims on this subject. Based on their history of being untrustworthy, there's no good reason that consumers, who've been betrayed by them so many times, should suddenly start believing them.

    Plus, why lump together the "Simoniz" units with all the others? This thread is the Simoniz Scam, not the pressure washer scam. Was the one defective unit a Simonz? How many Simoniz were sold? We'll never know for sure, because the Crappy People will never offer proof.

    More over, who among the cheated and mistreated consumers will actually care what a self-confessed owner/manager likes or dislikes? Naturally, a liar would like their own dubious and self-serving math, LOL!

    Finally, it's unlikely that someone who actually sells many "Simoniz" units, can't even spell the name.

    No, consumers need to know just how bad these units are, and the trap the Crapp People have laid out for them.

    Nice try, Crappy Tire Liar, but you've got no credibility in the stores, and even less here.

    Think back to "illegal" return policy....not even ONE example where CT or any other retailer has been found to have an illegal policy

    Think back to profitability of dealers....proven yet again on your lack of knowledge

    I've been following this thread for quite a while.

    Apparently lots of others have, too. On average, about 50 people "view" this thread every day.

    It also shows up on lots of Google searches for "Simoniz", which might help explain why it's so popular.

    As for "lies", the only ones I've seen are from ct people, and most are from this strange "you are all fakers" poster. It looks like nobody really takes that weirdo seriously though. "Angry CT Guy" - LOL!

    The customers all seem to have done their homework and posted useful links and proof.

    For that "profit of dealers" topic, I haven't really been following. Maybe somebody told a lie, or maybe they didn't. It hasn't really be proven either way, maybe because nobody really cares? Doesn't really belong under the simoniz topic anyway.

    I've found an interesting judgment that's relevant to this thread, CPA, returns, warranty etc. The trouble is, where does it go, or should there be a new thread opened just for judgments so everyone can find it?

    If it's about a defective pressure washer, this thread might be best.

    If this wasn't a pressure washer, but it was about a refund for one of Crappy Tire's many defective 'repair only' product, then the "Repair Only Warranty" thread would make sense.

    If the main factor in the judgement was the SOGA or the CPA, then it would fit well into the Sale Of Goods Act thread.

    If it's some other kind of suit, you might check out the various threads on 'sue' and 'lawsuite', or start a new thread called something like "Lawsuits Against Canadian Tire", for things like injured customers and their families, wrongful dismisal, injured empolyees, etc.

    [1] Le Tribunal est saisi d'une réclamation de la part du demandeur. Diallo Abdou, pour le remboursement du prix d'achat d'un appareil nettoyeur à jets d'eaux (pulvérisateur) acheté de la défenderesse, Canadian Tire, magasin #231, en date du 27 mai 2007;

    [2] Le Tribunal constate l'absence d'un représentant de la défenderesse, bien que dûment convoqué et appelé lors de l'audition;

    [3] La preuve révèle que le demandeur a utilisé, une seule fois, l'appareil pour constater qu'il avait beaucoup de difficultés à le faire fonctionner et à le manipuler, et qu'en conséquence, l'appareil ne convenait pas à l'usage pour lequel il l'avait acheté;

    [4] Le Tribunal constate qu'il pouvait retourner l'appareil dans une période de 90 jours. Or, le demandeur déclare l'avoir rapporté le 10 juin, au magasin Canadian Tire, #231, soit seulement 15 jours après son achat;

    [5] On a alors refusé de le reprendre alléguant qu'il ne respectait pas les politiques de retour de Canadian Tire;

    [6] Considérant la preuve documentaire et testimoniale;

    [7] Considérant également des dispositions sur La loi de la protection du consommateur et notamment des articles ayant traits aux garanties et plus particulièrement à l'article 37qui énonce ce qui suit:

    "37. Un bien qui fait l'objet d'un contrat doit être tel qu'il puisse servir à l'usage auquel il est normalement destiné"

    [8] Le Tribunal est d'opinion que le demandeur a prouvé le bien fondé de sa réclamation;

    POUR CES MOTIFS, le Tribunal

    ACCUEILLE l'action du demandeur;

    CONDAMNE la défenderesse à payer au demandeur la somme 398,81 $ avec intérêts au taux de 5 % l'an ainsi que l'indemnité additionnelle prévue à l'article 1619 C.c.Q. depuis l'assignation;

    Sur réception de cette somme,

    ORDONNE au demandeur de remettre à la défenderesse, Canadian Tire, magasin #231, l'appareil en question, dans les 15 jours de la réception de ladite somme;

    CONDAMNE la défenderesse à payer au demandeur les frais judiciaires de 66 $;
